Pemenuhan Hak Anak Manusia Silver di Gedangan, Kabupaten Sidoarjo Perspektif Teori Kebutuhan Dasar Abraham Maslow dan Undang-Undang Perlindungan Anak

Abstract

The phenomenon of silver children in Gedangan, Sidoarjo Regency, reflects a social problem closely related to poverty, limited education, and weak child protection. Children working on the streets face health and safety risks and the loss of fundamental rights. This empirical legal research examines the fulfillment of silver children’s rights in light of Abraham Maslow’s hierarchy of needs and the Child Protection Law. The findings show that their rights have not been optimally fulfilled. Economic pressure, permissive social environments, and limited access to education and social services encourage children to engage in silver human activities. Based on Maslow’s theory, their needs remain primarily at the physiological and safety levels, while love and belonging, esteem, and self-actualization remain inadequately fulfilled. From the perspective of the Child Protection Law, violations occur particularly concerning children’s rights to survival and development, education, and protection from economic exploitation. These findings highlight the need for stronger family, community, and government intervention.
