DERADIKALISASI ASWAJA DALAM BINGKAI HUKUM

Abstract

This research discusses the deradicalization with the Aswaja approach in the legal framework of a case study at the Mojokerto Regency KUA. The occurrence of the development of the phenomenon of radical Islamic movements is not easy to let go. Radical Islam can penetrate the boundaries of social life because its spread is inclusive and unlimited. The research method used by researchers is descriptive with a qualitative approach. The research method was carried out using a case study approach related to religious instructors at the Mojokerto Regency KUA in providing counseling or coaching to counteract radicalism by using Aswaja ideology as an anti-radicalism movement. Reconstruction of Aswaja is important because the demands for life transformation are getting faster. Without carrying out the reconstruction, it is feared that Aswaja will lose relevance and actuality. The moderate concept shows that religious tolerance in Indonesia is very dynamic and requires a "moderate" concept whose way of presentation must be adapted to the context of the case and time. The concept of Tawaazun (balanced) according to positive law in Indonesia, to achieve a balance between rights and obligations. The concept of Al I’tidal (fair) according to positive law in Indonesia, guarantee of justice for citizens, can be found in several examples of existing laws and regulations. The conclusion of this research that it is hoped that the KUA (Religious Affairs Office) as the front guard for tackling radicalism is expected to be able to provide a solution approach in society.
