Abstract

Compared to other countries, Family Law in Somalia is a
bit late in changing, these changes began since the Law on The
Family Code 1975 was enacted, several aspects were updated
including those concerning Marriage, Divorce, Livelihood, Children,
Guardianship, Wills, Inheritance. and Polygamy. The main issue
related to these changes is Equality between men and women, in
general, the legal provisions of the Syafi'i Madhhab are not applied,
as seen in the regulations related to legal changes in several aspects,
the most prominent of which is the chapter Waris, where the
government applies a 1:1 division between men and women, this
aims to raise the status of women to be equal to men.
